General Terms and Conditions of PZ Pädagogisches Zentrum GmbH & Co.KG
1. Conclusion of Contract
The contract is concluded upon registration for the event and acceptance by PZ Pädagogisches Zentrum GmbH & Co.KG. If a participant registers for a course, this registration is binding.
2. Fees
The fees are due for payment at the latest at the beginning of the course. Exceptions to this rule are integrations courses (point 8). Payment is usually made by bank transfer 14 days before the start of the course; otherwise immediately in cash at our premises in Turnstr. 2-4 in 75173 Pforzheim.
If a third party (payer, e.g. employer) assumes the fee, a cost assumption declaration must be issued and signed by the payer. If events extend over several course modules, registration applies for the entire specified duration. In these cases, installment payments are generally possible; you will find more detailed information on the respective courses.
3. Registration Confirmation
Upon registration, you will receive a non-transferable registration confirmation. If you have not received this before the start of the course, please inquire at Turnstr. 2-4 in 75173 Pforzheim.
4. Invoicing
As a rule, you will receive an invoice four weeks before the start of the course. The invoice amount is due for payment at the latest on the first day of the course. (Exception see point 8).
5. Certificate of Attendance
PZ Pädagogisches Zentrum GmbH & Co.KG will issue a certificate of attendance upon request after completion of an event. The prerequisite for this is participation in at least 80% of the teaching units. The list of participants serves as proof of regular attendance at the events (courses, seminars, lecture series, working groups) and must be signed by the participants upon attendance.
6. Minimum Number of Participants
The prerequisite for the Durchführung of a course is usually the achievement of the minimum number of participants before the start of the course. Events that do not reach the required minimum number of participants on the first course date can be shortened or canceled. In these cases, the shortening is carried out with due regard and retention of the planned content and overall concept. Participants who do not agree with this shortening can declare in writing that they are withdrawing from the course. They will then receive the course fee back.
Likewise, courses that do not reach the respective minimum number can be carried out with consideration of content and organizational aspects if the participants are willing to pay a corresponding fee surcharge (levy). Likewise, courses that do not reach the respective minimum number can be canceled by PZ Pädagogisches Zentrum GmbH & Co.KG with a refund of the course fee. PZ Pädagogisches Zentrum GmbH & Co.KG will make this decision (shortening, levy, cancellation). They will then receive the course fee back.
7. Later Course Entry
Later course entry is possible once only up to the third course date with payment of the full course fee.
8. German as a Foreign Language/German and Integration
Deviating from point 2, the course fee for integration courses is due 8 days before the start of the course. Payment is usually made by bank transfer 8 days before the start of the course; otherwise immediately in cash at our premises in Turnstr. 2-4 in 75173 Pforzheim.
9. Travel Costs
If you are entitled to reimbursement of travel costs in integration courses, vocational language courses of the BAMF or in retraining by the employment office, funding can be applied for. If the competent authority pays the costs for the travel expenses and these are settled via PZ Pädagogisches Zentrum GmbH & Co.KG, the incurred travel expenses etc. will be reimbursed in cash on the account to be communicated in writing by the beneficiary.
10. Special Conditions for Computer Use
Use of software: The programs made available within the framework of the course may not be changed, duplicated, distributed or made publicly accessible in any way. Use is only permitted for the purpose of course participation. In case of violation, the participant is liable for any damages caused.
Internet access: If PZ Pädagogisches Zentrum GmbH & Co.KG provides internet access, its use is only permitted for the purpose of course participation. Internet pages with pornographic, racist or discriminatory content may not be accessed. In case of violation, the participant is liable for any damages caused.
Data loss, computer viruses: Each participant is responsible for securing his/her own data. PZ Pädagogisches Zentrum GmbH & Co.KG assumes no liability for data loss. PZ Pädagogisches Zentrum GmbH & Co.KG assumes no liability for damages caused by the application of acquired knowledge or by the use of created or changed programs or by computer viruses or other destructive programs.
11. Withdrawal/Refunds
a. PZ Pädagogisches Zentrum GmbH & Co.KG can withdraw from the contract due to insufficient participation, cancellation of a lecturer or for other justified reasons. In these cases, any payments already made will be refunded: Course fees will be refunded in these cases. Course fees that have been paid in cash will be refunded in cash at our premises in Turnstr. 2-4 in 75173 Pforzheim upon presentation of an identity card/driver’s license/passport at your request. Further claims against PZ Pädagogisches Zentrum GmbH & Co.KG are excluded.
b. The withdrawal of a participant must be made in writing at the latest 6 working days before the start of the course. Staying away from the course does not count as an unsubscribe. If a different withdrawal regulation is expressly stated in the course prospectus, this shall take precedence.
The decisive factor for compliance with the deadline is the receipt of the withdrawal by PZ Pädagogisches Zentrum GmbH & Co.KG. There will be no refund of course fees for later withdrawals.
c. The declaration of withdrawal to the lecturer is ineffective.
d. Special withdrawal conditions and cancellation fees apply to German and integration courses including exams:

The withdrawal of a participant must be made in writing or in person at the latest 15 working days before the start of the course.

For the registration for the German exams, the currently agreed fee will be charged. If you do not appear for the German exams without canceling 35 days before the exam date, a cancellation fee of the currently agreed fee will be charged. The same applies to cancellations after the cancellation deadline.
12. Copyright Protection
For copyright reasons, we would like to point out that photographing, filming and recording on tape is not permitted in the events. Teaching materials may not be used in any way without the approval of PZ Pädagogisches Zentrum GmbH & Co.KG, in particular not duplicated, distributed or publicly reproduced.
13. Liability
The liability of PZ Pädagogisches Zentrum GmbH & Co.KG is limited to cases in which there is gross negligence or intent on the part of PZ Pädagogisches Zentrum GmbH & Co.KG or its vicarious agents. Deviating from this, PZ Pädagogisches Zentrum GmbH & Co.KG is liable in the event of injury to life, health or body, as well as in the event of a breach of essential contractual obligations, even in the event of simple negligence.
14. Obligation to Mitigate Damage
The participants are obliged to do everything reasonable in the event of a disruption or accident to contribute to remedying the disruption or to minimize any damage that occurs.
15. Severability Clause
If individual provisions of the General Terms and Conditions are invalid in whole or in part, this shall not affect the validity of the remaining parts of the contract. The invalid provision or its invalid part shall be replaced by a provision that corresponds to the presumed will of the parties or comes closest to it economically.
16. House Rules
PZ Pädagogisches Zentrum GmbH & Co.KG is a guest in the buildings it uses. We ask you to observe the house rules, not to smoke in the buildings and on the school grounds, which go up to the property line, not to consume alcohol and not to park. Political, religious or commercial advertising is not permitted in the events of PZ Pädagogisches Zentrum GmbH & Co.KG.
17. Holidays and Public Holidays
Unless otherwise stated or agreed, courses do not take place on public holidays. Subject to change.
18. Written Form
Deviations from this agreement must be made in writing. This also applies to the waiver of this requirement.
19. Data Protection
The personal data that the participant provides to PZ Pädagogisches Zentrum GmbH & Co.KG will be processed and used electronically insofar as it is necessary for the establishment, execution or termination of the contract and customer care. The collection of personal data takes place exclusively for our own business purposes in accordance with the General Data Protection Regulation. You can find our data protection declaration at https://ukraine.pforzheim.de/refugees-from-ukraine/bildung.html. Your data will be stored with us for 10 years. The data protection according to the BDSG is observed. The personal data provided in the EDV training network are treated confidentially (§ 3 Abs. 1 BDSG). Participants who store their data in the EDV training network agree that the data they have stored in the courses will be deleted by PZ Pädagogisches Zentrum GmbH & Co.KG after the end of the course. 20. Place of Jurisdiction
The place of performance and jurisdiction for all disputes arising from or in connection with this contract is Pforzheim.
21. Final Provision
With the publication of these terms and conditions, all previous ones lose their validity. Status: 02.06.2020
Instruction on Right of Withdrawal under Distance Selling Law
In the event that the registration is concluded in accordance with the provisions of the Distance Selling Law, you will find the following legally prescribed instruction on the right of withdrawal and the consequences of withdrawal below:

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the contract conclusion. To exercise your right of withdrawal, you must inform us, PZ Pädagogisches Zentrum GmbH & Co.KG, 75173 Pforzheim, Turnstraße 2-4, of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax or email). You may use the attached sample withdrawal form, but this is not mandatory. To comply with the withdrawal period, it is sufficient for you to send the notification of your intention to exercise your right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen a type of delivery other than the cheapest standard delivery we offer), immediately and at the latest within fourteen days from the day on which we received your notification of withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise with us; in no case will you be charged any fees for this refund.
